Intention to prohibit new substances under the cloak of application of the cosmetics regulation

On November 17, the European Commission published a draft amendment to Regulation 1223/2009 on cosmetic products

The draft measure is necessary to enact the prohibition of using, as cosmetic ingredients, substances classified as carcinogenic, mutagenic or toxic for reproduction (CMR) by Commission Regulation (EU) No 2022/692, which has been adopted on the basis of the CLP Regulation and will be applicable from December 1, 2023. Therefore, the amendment of the Cosmetics Regulation is necessary to transpose the new CMR classification provided by Regulation (EU) No. 2022/ 692 of the Commission.

The proposed date for its adoption will be the third semester of 2023.
